Terms of Service

The agreement between you and Stack the Lineup, including how billing works and what the app is and isn't meant to do.

1. Acceptance of Terms

These Terms of Service (these "Terms") constitute a binding agreement between you and Stack the Lineup ("Stack the Lineup," "we," "us," or "our") governing your access to and use of the Stack the Lineup mobile application (the "App") and this website (together, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, access, or use the Service.

2. Description of Service

The Service is a planning tool intended to assist coaches in constructing a batting order, assigning defensive positions on an inning-by-inning basis, identifying potential fair-play issues based on rules that you configure, tracking pitch counts that you enter, and generating PDF exports.

The Service is a coaching aid only. It is not an official system of record, does not officiate games, does not report to any league, and does not replace your league's official rulebook or scorekeeping procedures.

3. Fair Play Warnings and Pitch Count Disclaimers

This Section is of particular importance and should be read carefully.

Fair-play warnings, position checks, and pitch-count eligibility indicators generated by the Service are calculated solely from the rules you configure and the data you enter. Their accuracy is entirely dependent on that configuration and input. Such indicators may not correspond to your league's actual rules and may be inaccurate if any setting, inning count, or pitch count is entered incorrectly or omitted.

You are solely responsible for compliance with your league's rules and for the health and safety of your players. You should not rely on the Service as the sole basis for determining a player's eligibility to pitch, the rest a player requires, or whether a lineup satisfies your league's requirements. You must independently confirm compliance against your league's official rules and exercise your own judgment regarding player workload and wellbeing.

Certain features of the Service require a Stack the Lineup Pro subscription ("Pro"). Pro is offered through Apple's App Store as an auto-renewing annual subscription and may include a free trial for new subscribers, subject to the following terms:

6. Legacy One-Time Purchase

If you purchased the previously offered one-time Stack the Lineup Pro unlock, that purchase continues to entitle you to full Pro access. You are not required to subscribe and will not be charged again for Pro access. To retain access on a new device, sign in with the same Apple Account and use the Restore Purchase function.

7. Free Features

Batting order construction, position assignment, fair-play warnings, roster import, and the Batting Order PDF export are available without a Pro subscription. We reserve the right to change which features are offered free of charge over time; however, we will not revoke access to a one-time Pro purchase already made by a user.

8. Acceptable Use

You agree not to use the Service to violate any applicable law, infringe the rights of any third party, or store information that you do not have the right to store. You agree not to reverse engineer, resell, or redistribute the App except as expressly permitted by the App Store's terms of service or applicable law.

9. Intellectual Property

The App, this website, and their design, source code, and branding are owned by us. Your roster, lineups, notes, and game history remain your property. We claim no ownership interest in the information you enter into the Service.

10. Availability and Modifications

We may update, modify, or discontinue features of the Service at any time. While we endeavor to avoid disrupting functionality that coaches rely on during an active season, we do not guarantee that the Service will be uninterrupted, error-free, or compatible with every device or version of iOS.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Apple as Third-Party Beneficiary

These Terms are an agreement between you and us; Apple is not a party to these Terms. Apple is not responsible for the Service or its content and has no obligation to furnish any maintenance or support for the Service.

In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any, to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, or claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any claim that the App or your possession or use of the App infringes a third party's intellectual property rights.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

14. Termination

You may stop using the Service at any time by deleting the App. We may suspend or terminate your access to the Service if you violate these Terms. Deleting the App removes the data stored on that device; see the Privacy Policy for further information.

15. Modifications to These Terms

We may modify these Terms from time to time. If we do, we will revise the date at the top of this page and post the updated Terms here. Your continued use of the Service following any such modification constitutes your acceptance of the updated Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of such courts.
